Yeah... I'm not really excited about this prospect either. But, I don't think there was any time to bring a third party to hold funds. Had I insisted on that, I don't think we would have been able to close. That would have been unfortunate for the buyer who has everything ready to go. He would have likely incurred additional fees to redraw docs and possibly lost his rate.
I do, of course, have provisions in the escrow agreement indemnifying me and requiring them to pay any legal fees that might result from their dispute and I have a lien on the escrow funds. I am fairly comfortable with that.
In the end, I hope that they can work this out in a few days time and get this out of the way.
