It is a RESPA violation, regardless if it is a cash deal or not. If it was a private sale then it may not be. But the fact of the matter is: It is a Licensed Agent steering a closing to a particular Title Company. If nothing else it violates the NAR's Code of Ethic's.  Tell me they aren't getting padded!
