I had a good smile too with Alix's post! -- which made me want to post my dilemma. How do you think I should take action against an attorney? I did some right-of-way work for him back at the end of August for an agreed fee. I travelled to a county I do not normally cover and completed this for him in a timely manner. I had done a previous larger project for him and he paid me all but $130. He told me he would also pay this. Anyway, he seems to be ignoring me. I have sent bills by fax & email with return notification requested. He has read the emails but has chosen not to respond to me.
This guy just dabbles in real estate. He has a workmen's comp practice. He used to work for a right of way company. He seemed to be a nice person and actually came to one courthouse I was working in to meet me back when he asked me to do the other row project. Should I first threaten to report him to the bar and then do it? (While he is not a young man, he does have young children and I don't wish to hurt them but I need my money too). Should I send him a demand letter by certified mail and then take him to small claims court if he still doesn't make payment arrangements? He is about 70 miles from me. I'd appreciate any of yours opinion as to how to proceed with collecting what is owed to me in the most professional and tactful way. Thank you in advance!
