I have a client who is driving me insane about private road agreements. This is a VERY large Michigan company who should know by now that at least in the rural southern counties, just because a road is marked as "private" doesn't mean there was EVER a private road agreement OR easement recorded. I always get the same response: we need you to search for that agreement.
Well, ok....how far back do you want me to go? 1980? 1880? When was the road created? And questions like that. (And what do I do when the PLAT shows that the road is clearly public (because they have the private roads marked accordingly, but the Road Commission tells them it's private?)
Is this something you're running into and how do you handle it?
