Some clients list on their order forms to search for mineral rights (amoung all the other things) on a refi or purchase search. We have never actually found who owns the mineral rights due to the fact that it could take a search back 100 years or even to the patent to really follow the mineral rights chain verses the surface ownership chain. I'm assuming this could cause a liability issue for the title company if a home owner thinks they have mineral rights when infact they don't. Is anyone here concerned about this issue and how do you address it?
