I have been blogging about Private Transfer Fee Covenants for over two years. My most recent post, Freehold Licensing, NKA Freehold Capital Partners, At It Again, has links to the previous posts. As I mentioned in the blog, I was recently interviewed for an article in the Washington Post. See - A new real estate cost to watch for: Developer's private transfer fee.
I believe this column is syndicated, so I hope it helps to create more awareness about these covenants. A handful of states have passed legislation banning them and some others are working on it, including Ohio.
Abstractors should be aware of these and it will be very important to keep a close eye out for them in your title searches. If you miss one, it could be costly.
Best,
Robert A. Franco
