Actually, I am in favor of healthcare reformation. My complaint is that the current bill does not go far enough...does not include the government option...no clear definition of reduction of premiums and control of the insurance industry's price gouging. I would prefer that the insurance companies be removed from healthcare entirely.
The government certainly has the right to mandate insurance coverage as is exemplified by the states' requiring auto insurance and worker's compensation insurance..
I really do not think that any constitutional rights have been violated. If not found in the black letter law of the constitution I am sure that it can be found in the penumbral areas. There is also the ninth amendment to rely upon. The biggest complaint I have heard uttered from the states so far is that the bill violates the 10th Amendment and states' sovereignty. If that is the best argument that can be mustered I think they are going to have difficulty getting past the Supremacy Clause.
