The subject property in a title search is put up as collateral in a criminal case to cover a bail bond. Because of clerk error or system failure the bail bond document never gets recorded in the registry of deeds. You will not find it doing a civil search.
Take it one step further....the subject property is put up as collateral in Boston Massachusetts as collateral in a criminal case. The court system there neglects to file a copy of the bail bond in the appropriate county registry in Maine. So, now shouldn't you also be searching every town, municipal, county, state and federal court in Maine and Massachusetts, or for that matter everywhere for real estate related filings in addition to all the civil courts?
