[-] Update on an old blog post - Slade Smith/OH (5 replies)

Out of curiosity, I just Googled to see if there were any recent developments in the foreclosure case of Greg and Diana Horoski, the New York couple who had their mortgage debt cancelled by a judge because of bad faith conduct by their lender.  (You may recall Robert Franco's blog on the case, in which Judge Jeffrey A. Spinner ordered the mortgage debt to be "cancelled, voided, avoided, nullified, set aside and of no further force and effect." and the mortgage to be "vacated, cancelled, released and discharged of record.")

Well, the lender's appeal of that case is still pending apparently-- at least that's the latest information I can find-- but I did happen to see that Judge Spinner has been up to his old tricks again recently, ordering a lender to pay a couple a $100,000 penalty for engaging in a calculated and premeditated attempt to rack up interest penalties and late fees on othe couple's mortgage.

Ouch!
