I'm not sure that I can address this directly, but I would note that our firm does pre-Construction loan property inspection for priority breaks and building inspections. Any, any, ANY improvements are noted by us for their potential to be breaks in priority, easements, construction issues, property damage, possible claims or losses, or future easements. I've never in over a decade encountered a situation where disclosure of such matters creates a liability on our part as property or building inspectors. If a picture is worth a thousand words, then photograph the matter and allow the insurer, realtor or client decide on the effect of such information.
