There are provisions in California's government code for local agencies to place notice on public record in the Official Records indices.  I'd suspect that other states have similar code provisions.  This is why I am very unsympathetic to the public servants who failed to record a notice and why I think it should not be held against the new buyers.  Public officials who fail to exercise the rights and authorities they have are negligent in that way.
