1. current owner search and record mortgage.

3. I was asked to record mortgage, as long as no other encumbrances except first mortgage was on record.
4.That is the same feeling I had on the issue, name and address of property matched locus. another search was done when the property sold. The mortgage was not paid off at the time of closing. (I had nothing to do with that search)
5. I do have E & O and they have been great, but thought I would see what this forum had for opinions. I have also been in contact with a lawyer in case I feel I need one on my own, but so far the E&O has done a great job of inquiring and keeping in touch with me.
2011, I am definitely going to start having my clients sign disclaimers. This is one thing I never thought of worrying about. The document itself, it also raises the question "Are we liable for the documents accuracey that we record." This could mean discharges, sub agmnts etc referencing the correct instruments.
