Very true. In fact knowingly failing to ask the right questions can also result in a conviction. Willfully remaining ignorant of facts when there is a need to make inquiry is almost tantamount to knowingly being complicit in a criminal act.
I saw this become an issue several years ago in federal court. The defendant was ultimately convicted and sentenced to serve two years in Danbury prison
