Borrowers Not Prevailing on Flawed Assignments Despite Ibanez Decision

After the Massachusetts Supreme Judicial Court voided a foreclosure in U.S. Bank v. Ibanez, numerous lawsuits have been filed by current and former Massachusetts homeowners who have been subject to foreclosure judgments, alleging that their foreclosures occurred under the same circumstances as the Ibanez foreclosure.  That may be the case... but they are losing nonetheless.
