Is a court clerk, who conducts a civil or criminal records search, when there is no public access to the records, liable for errors and omissions?
Would the court or state be liable when the clerk misses a case listing, forgets to run a subject as a plaintiff and doesn't state it or doesn't really do the search and clears the subject?
I realize that each state may have a different scenario or statue but I would like to get a reading on the legal side of this and some opinions.
