A Federal Subrogation Law for Refinance Mortgages?
At the peak of the housing bubble-- after a historic refinancing boom in which, in just a three year span, there were nearly as many refinance transactions as homes with mortgages-- two legal scholars wrote an article for the Brigham Young University Law Review arguing that refinances were being held back by the cost of all the unnecessary title work that was being performed.
