An article in the Maryland Daily Record concerns me. The Maryland Court of Appeals has determined that a title company's duty of care means it can be sued for negligence as well as breach of contract.
While it is not yet known how this will impact our industry right now in Maryland, I believe that many, if not all, title companies in Maryland will start to add some very explicit language in their commitments that will (hopefully) negate any liabiity they may have.
