I have done a lot of research and have attended a seminar on the new health insurance law.  There is a tremendous amount of misinformation out there.  The insurance companies are playing some games.

If you have a small business the SHOP portion of the new health care law does go into effect 1/1/2014 and that is where the small business owner can get a tax credit.  It has to be the SHOP exchange to qualify.

However, individually you can go through the health exchange and get a much better rate and possibly a subsidized plan.  By the way, I don't think a $13,000 deductible is permitted under the new law.  Some plans are being discontinued because the fail to meet minimum standards and the the insurance companies are trying to steer people into more expensive plans.  This is not required.  There are plenty of reasonable plans out there.  In fact, under the new law the rates for "older" people should go up less than before because of some of the requirements.

My company probably will not go through the SHOP plans.  It works out for us that the tax deduction will be about the same as a tax credit.  Going through a "private" plan and taking the tax deduction allows to stay with the same plan we have now.  This is a little complicated to calculate but I used my accountant to help out.
