I agree with the findings. The consumer hired an attorney or a title company, the attorney or title company should be liable for the work of its vendors. The attorney or title company if found guilty can file suit against the abstractor in a separate action to recover its losses. They can still use non attorneys they are just liable and always have been for the abstractor or vendors they use. If any vendor makes a mistake, the customers only resource would be to sue the person they hire  as they can only sue whoever they hired, harmed or hurt them, then it is my job to recover my loss from the vendor. I hope this helps to make things clear for anyone. This is standard procedure. It matters who you do business with. This is why the CFPB is holding lenders liable for its vendors as many are outsourcing to India to save wages which is fine but a consumer should not have to fly to India, hire an attorney and sue in India. Is India liable for American laws? Only if they are licensed in America and many are not but state they have an office in America. To fix the problem, the lender or title company in America can outsource to who ever they choose but saving money per file is not always saving money as you can see and American title examiners make errors too but who would use any company who make a lot or consistent errors.  In this post we of course have no idea who the abstractor was on shore or off shore but either way, the right settlement occurred. I too want to post that there may be good title examiners in India, how would I know as we do not off shore but a lot of the big boys do as they have their own title plants and offices in India for this reason to save money. I am happy that the CFPB is holding the lender liable for its vendors, not that I want bad things to happen to the lenders but that maybe they will pursue a better quality abstractor instead of the cheapest person do to claims and maybe this could be me and help my company, which is my hope. Thanks for all of the Great Abstractors out there who care about our industry and deliver a great quality product. God Bless you all and thanks for what you do and have done for my family. Without a great title exam and great title examiners, I would be out of business. Keeping it local as long as I am able, still using American Independent Abstractors to serve our clients.
