"Abstractor" Gets Drilled By Cops Over Fake Gas Rights
   

A self-described Pennsylvania "abstractor" is in trouble with the law after allegedly filing false deeds purporting to grant gas, oil and mineral rights to himself on numerous parcels that he did not own.

John Walker, 59, of Dubois, Pennsylvania, faces 33 counts of theft by deception and two counts of tampering with public records.

According to authorities, Walker deeded himself a 40% interest in mining and extraction rights on a 2,765 acre tract in Morris Township in Clearfield County known as the Wigton Coal Reservation via quit claim deed, then deeded the tract to his wife.  Walker had no surface interest in the tract when he deeded the interest to himself, according to the allegations.  In 2008, an oil and gas company, Little Pine Resources, sought to obtain oil and gas rights on three parcels owned by an estate.  The parcels lay within Walker's targeted tract.  When a title attorney conducted a title search for Little Pine Resources, he issued an opinion that Walker's deeds clouded title on the estate's parcels, and commenced a quiet title action on one of the three parcels.  Walker was contacted, and gave up his interest in that parcel immediately. 

When police contacted Walker about the suspicious deed, he admitted he made a mistake, but claimed that he filed the deeds only after seeking the advice of oil and gas companies. He claims that he has gained nothing so far from his interest in the property, but says he "had the potential to make $9 million."  Walker also admits to filing similar deeds on other properties.

"As a result of fraudulent deed recordings, land owners in the Morrisdale area seeking to enter lease agreements with gas companies may be required to file lawsuits to protect their legal interests," said William Shaw, Clearfield County District Attorney.  "Gas companies intending to drill wells are reluctant to enter lease agreements when ownership of the gas rights is clouded by fraudulent deed recordings," costing homeowners thousands in legal fees to clear up the title issues, according to Shaw.

A search of the Source of Title business directory revealed no listed abstractor by the name of John Walker.

With the title problems they run into in Clearfield, it wouldn't be hard to pull something like that off.  The Little Pine folks are good people, I ran oil & gas titles alongside some of them up there.  Seemed as if everything I got had something wrong with it, some cloud or else it ran back into a Sheriff's Sale or Treasurers' Deed.

One attorney I talked to had a client who wanted to sell his homestead farm.  Turns out the last recorded deed was in 1895 from into
the great-grandfather, who passed away in 1925.  No one in the family ever bothered to raise an estate or execute a deed to the heirs, just kept paying the taxes.  Needless to say, having to run down an heirship chain spanning 80 years would not be a fun task!

Come'on Scott, be honest, a search like that does sound kinda fun doesn't it? Economics and productivity quota aside, that search does sound like it would be stimulating.

Yeah, I suppose if one were to undertake it as a hobby, it probably would be interesting to see what "skeletons-in-the-closet" one might find.

I've been doing searches like these in West Virginia the past two years for oil & gas clients (and before that in New York and Pennsylvania).  Every other title I work on seems to be a 60 to 80 year heirship search, because of course in West Virginia and southwestern Pennsylvania everyone reserved their oil & gas rights around 1900, depending on the county. The amount of oil & gas owners and parties with leasing rights/royalty rights can be from a couple to over fifty. Add to that some of these rural counties don't seem to have a hospital, so the death gets reported in some other county and never gets cleared in the county they have interests in; like Scott said, one heir of many just keeps paying the taxes.

     I love running title searches for oil & gas rights in West Virginia.  It is very challenging.  There is always something new to learn and discover when searching the chain of title as far back as possible and 'running foward' the owners of the severed oil & gas rights.  It is always interesting because finding these owners is not always the same process, and every county has their own quirks with their older records. 

     I've done some work for real estate transactions, as well as gotten to know some of the local abstractors/searchers.  I found it to be a much more simple process that takes a few hours to complete a search as opposed to a week on average in West Virginia oil & gas title searches.  The problem is the sporadic work of the oil & gas clients, as well as some of the 'abstractors' they hire with no experience.  I would much rather have a more permanent job doing 20 - 40 searches with people that more experience.
