Another question about equitable subrogation is where it would be implemented first.
The title records of the Counties seem like logical places to expect it, but there are other records indices that may be ripe for "sliding it in" the proverbial side-door.
State indices of UCC Financing Statements might be a place for it to occur, as might also be the local district records of Federal zones like Guam, D.C. and Puerto Rico. This would not be atypical; get it tested in an area where the kinks can be worked out and then bring it into play in an rural county setting.
The proposed Federal land registry system seems like it would be the "perfect" place for something like this to be used, too.
Anyone else with ideas of where such a theory would be implemented?
