Ok, if they were Developer requirements and restrictions, and they expired.  Expired = Expired.

And, if there is no longer a "Developer", then the CCRs are ancient and unenforceable.  So, it would be hard to simply "reinstate" something that does not exist.

They have to start from Square 1 to create new CCRS that all persons in the Subdivision agree to.

I also used to work with multiple developers in 8 different developments building new construction housing.   

The prior restrictions will always be excepted from title coverage, whether or not the CCRs, HOA or PUD is defunct or not.

The bottom line is what do the current deeds recite as to the CCRs and if there was an expiration date, then the CCRS are not enforceable but still not insurable from the title aspect.to post a reply: login - or - register
