Maybe this would be handled differently in different areas.  I have spoken to several different title attorneys here in Ohio.   All agreed that the forclosure should have been filed against the heirs of or estate of ______.  If they wanted to use the executors name, it should have been filed as Robert states above, in addition to the decedants name.

This brings to mind another issue.  In your state, if the person currently vested on a piece of property is deceased.  Who is in title?  

And Kevin I know the answer, I am just putting this out for discussion & educational  purposes. 

I think we need more discussion about actual title problems on this forum.
