I think what you may be overlooking is that there is a loss of priority in the event of foreclosure. There is also the matter of a reduced market for the assignment of the mortgage with the possibility of having to discount the note for a reduced sale price. All of this is ripe for damages issues. Ultimately whether there is a loss will be determined by the trier of fact, but reduced expectations are legitimate matters of concern.
