I would be very surprised if you could collect it. Late fees fall pretty much into the same category as interest on delinquent accounts. You need to check your state's position on it. In Connecticut neither is collectable unless there is a written contract providing for it or a statute that does the same. In the absence of a written contract you are pretty much left with legal interest following a judgment in a law suit.
